Prior to the formation of our team as Free Now Foundation, we operated as the original, founding members of Children’s Health Defense – CA, and during those first few years, as CHD-CA, we were co-petitioners on a lawsuit against LAUSD for their illegal Covid-19 vaccine mandate/policy. The lawsuit, though technically dismissed, is back up for a hearing this coming Wednesday at the Stanley Mosk Courthouse in Downtown Los Angeles. This lawsuit represents two key tenants central to the core of our mission — medical freedom, the ability to choose what we put into our body; and civil rights — no school district has the legal authority to implement a vaccine mandate or policy. Although the Covid years may seem long gone, the issues that we so strongly fought against are still front and center. Will you help us by showing up to the press conference? Bring your family. WHEN: Wednesday, January 10, 2024 at 8:30 a.m. PST

 

WHO: 

  • FACTS LAW TRUTH JUSTICE (“FLTJ”): a human and civil rights advocacy group and constitutional lawfirm fighting to protect children and families from tyrranical, illegal, unconstitutional, unscientific and dangerous government overreach.
  • Parents and Children from the Los Angeles Unified School District (“LAUSD”) whose children have been vaccinated without their consent, denied an education, and otherwise harmed as a result of LAUSD’s illegal COVID-19 vaccine requirement, which the Court held to be illegal and void in 2022.

 

WHY: Press Conference at 8:30 a.m. before the 9:30 a.m. hearing on FLTJ’s Attorneys’ Fees Motion to recover fees incurred by charitable organization, Children’s Health Defense – California Chapter (“CHD”), as a result of LAUSD’s refusal to withdraw – or, at the very least, postpone – enforcement of its first-in-the-nation COVID-19 vaccine requirement until a final ruling on the merits of CHD’s lawsuit challenging LAUSD’s authority to do so. Ultimately, LAUSD postponed enforcement of the Requirement twice in response to CHD and Protection of the Educational Rights of Kids’ (“PERK”) motions and oral arguments, and the Court adopted FLTJ’s legal analysis, finding that the Requirement was illegal and void.

LAUSD is opposing CHD’s Motion on the grounds that CHD and PERK’s two-year+ lawsuit, which involved three emergency requests to prevent enforcement of the Requirement, extensive requests for oral and written discovery, and threatened motions to compel, did not “result in any significant public benefit” and was not “a substantial factor” in LAUSD postponing enforcement of the Requirement two times and, ultimately, rescinding it. LAUSD is wrong and the law – and facts – are on CHD’s and FLTJ’s side, entitling it to recover all of its fees.

This lawsuit conferred a significant benefit to the almost-6 million schoolchildren in the state who would have otherwise now – and in the future – be subject to random vaccine requirements from all of the over 1,000 school districts without notice or an opportunity to be heard before. This lawsuit also specifically prevented the over 600,000 LAUSD students from being forced to enroll in the clinical trials of a new, non-FDA approved drug in order to exercise their right to free, public schooling, or to attend LAUSD’s failing, overburdened “online alternative,” and to their familes faced with the impossible decision of vaccinating their child against their wishes, or otherwise pulling them from school or moving, among other things. CHD is entitled to its fees because, even if the related case G.F. v. LAUSD received its ruling voiding the Requirement, first, only CHD fought the District and moved the Court consistently for two years to prevent enforcement of the Requirement until G.F. did.

CHD, PERK, and LAUSD families traumatized and harmed by the illegal Requirement ask that press and media cover the hearing to (1) expose the District’s arguments and beliefs regarding its legal authority when it comes to directing the health of children in its care, and (2) the Court’s analysis and ruling on the merits.

PROCEDURE:  All press / media must file form MC500 with the Court by midnight, Wednesday, January 3, 2024, in order to have access to the hearing, in chambers.
