In a first and only jury verdict in a COVID vaccine exemption case, a jury found that Bay Area Rapid Transit (BART) denied employees any accommodations after they submitted religious exemptions to COVID vaccination. BART also failed to show undue hardship to justify not providing those accommodations.

The 100% vaccinated jury found that BART caused them emotional distress, awarding six plaintiffs more than $1 million each. Prima facie, this looks like a religious exemptions case, but the case was actually argued using Title 7.

“This case shows what juries really think about these issues,” said litigator Jessica Barsotti, “Courts have been nervous about jury trials in COVID shot exemption cases, such as our masking case against Yorba Linda School District where we were headed to a jury trial, then the judge did a sudden about-face and threw out the case.” Jessica went on to say that she “loves jury trials because juries always get it right.”

    We need a CA Constitutional amendment for medical freedom. The time is now, while people still have fresh memories of the Plandemic and before the next Plandemic promised by Bill Gates and Tony Fauci.

      I was Kaiser Permanente Nurse Practitioner who was fired with several of my colleagues for declining to take the Covid19 injection due to our religious beliefs. Our situation appears to be exactly the same as this case. Unfortunately I was unable to join the live Zoom discussion due to technical issues.

      I have reached out to the Free Now Foundation for legal assistance in this matter in the past and was advised that no cases were being prosecuted at this time.
      Since the Bart litigants were successful, it would appear that now there is a legal precedent for our case.
      What is the next step in this process.
      Please advise.
