Health Department likely trying to provide cover for LA Schools unlawfully rejecting the ADA Waiver

[BREAKING] Los Angeles Department of Public Health Director, Barbara Ferrer — of COVID lockdown notoriety — has slapped an unlawful red box warning on their website. It states:

ATTENTION: Forms provided by Frontline Health Advocates (or similar entities) do NOT meet the California Immunization Law requirement for medical exemption, and will not be accepted for admission to pre-school programs or schools in Los Angeles County.

Per California Health and Safety Code, Section 120325-120370, only medical exemptions issued in CAIR-ME by a physician licensed in California (or proof of receiving required vaccines) meet the documentation requirements for school admission/attendance.

The situation is simple—and deeply concerning: school districts, including LAUSD, have been unlawfully rejecting federally protected ADA vaccine waivers.

These ADA waivers, created by our partners at Frontline Health Advocates under the leadership of medical-legal expert Dr. William Lionberger, are not optional guidelines. They are federal disability accommodations backed by the Americans with Disabilities Act. Under federal law, schools must honor these waivers.

Cease & Desist Letter Sent to Ferrer’s Department of Health

Ferrer’s Department’s statement is not merely misleading—it is illegal. Federal ADA protections supersede state vaccine mandates. No state or district has the authority to nullify a federal civil-rights accommodation through a website disclaimer.

“Think of a corollary situation with handicapped parking placards,” said Mayer, “What if California’s Department of Motor Vehicles — instead of just issuing handicapped parking placards based on orders from a driver’s medical doctor — were also in charge of deciding the validity of the doctor’s disability assessment? Even if the DMV hired medical doctors to do this work, those doctors wouldn’t examine the patient who has the placard, and they would violate due process by issuing an unwanted and binding second opinion. What if these fictional DMV MDs denied every parking placard, the way the Department of Public Health denies all valid vaccine medical exemptions for disabled students?”

Luckily, the ADA doesn’t work that way.

The absurdity of a State scheme trumping federal ADA protections is lost on Newsom, Ferrer and California’s Department of Public Health.

We had to point it out.

Our legal partner — Disabled Rights Advocates, LLC — issued a cease-and-desist letter demanding the statement’s removal. The LA Department of Health has yet to comply.

ADA Waivers Are Non-Negotiable

California has the most strict vaccination mandates in the country, leaving medically vulnerable children without any safe or lawful path for school attendance. The ADA fills that void. It requires schools to provide reasonable accommodations when a child’s health or safety could be compromised by a mandated medical procedure.

ADA protections:

    • do not depend on California’s immunization laws
    • cannot be vetoed by a school district administrator
    • cannot be overridden by a school nurse
    • cannot be dismissed through misleading website statements

Every time a school denies an ADA waiver, it is violating federal civil-rights law.

No one has to put up with either one of you doing illegal, corrupt things, that try to take away the Americans Freedoms. Not Going to Work This Time!! IM READY TO FACE BOTH IF YOU!!

    Please file a lawsuit against the California Department of Public Health. When school districts don’t follow their guidelines, especially the CAIR-ME system, the district gets audited and penalized financially. CDPH puts these mandates in place, and they are violating federal ADA rights. CDPH uses the school districts as their minions and shields.

        Our private daycare and preschool facility is audited and threatened with de-licensure by Santa Clara County Public Health Department. The practice is granular, down to the kiddo and to individual shots in each series.

          That’s frightening! Santa Clara County has been totally out of control since 2020. This is exactly why we have lawsuits to end this tyranny. The ADA waiver may work there, if your child qualifies for an ADA disability. Please contact frontlinehealthadvocates.com to see if your child might have an ADA-qualified condition or not, and to learn more about its success in preschools. Since you’re in Santa Clara, please come meet me and the team in May in Silicon Valley when we have our annual Spring Gala.

    lausd thinks ed code is law & they preach it as so not knowing true law not mandates & policy are only guidelines for law but push them hard as if they were relevent the more lawsuits against them the better & will hopefully put them & the little nazi health dept back in there place of advising not being dictators
