In July’s Legal Warrior Club Zoom call, Chairman Alix Mayer interviewed Richard Fox MD JD about some significant legal wins in U.S. federal courts. In this insightful dialogue, Dr. Fox explains the history and context of each federal court decision, and the positive impact these decisions will have on our lawsuits in California.

We are excited to announce that after this Legal Warriors Club call, we raised the final dollar needed to start our lawsuit to bring back the legitimate medical exemption so students of California who need an exemption can attend school safely!!! This is Free Now Foundation’s ELEVENTH case, and our first non-COVID Era case! We are thrilled to partner with the many supporters like you who made this happen!!!

Dr. Richard Fox discusses the significance major wins in federal courts, that will affect positively medical freedom cases in California, including ours! He discusses:

• COVID Shots Don’t Prevent Transmission: The 9th Circuit Court decision regarding COVID shots and transmission. The judge ruled that the Defendant, Los Angeles Unified School District, could not prove that COVID shots prevented transmission, therefore a very old case, Jacobson 1905, could not be used as a precedent for COVID shots. In 1905, it was believed that smallpox vaccination stopped transmission, so the Jacobson case supported mandates. This case has been remanded to a lower court where the Defendant will not be able to argue COVID shots stopped transmission. Back in November 2020, I wrote about the issue of lack of proof of transmission reduction when I published an article in The Defender about all the COVID shot early release studies and study protocols. I quoted the Chief Medical Officer of Moderna, Tal Zaks, who said “our trial will not demonstrate prevention of transmission, because … you have to swab people twice a week for very long periods, and that becomes operationally untenable,” citing the need for a five-to-ten times longer trial length and even higher costs. Shout out to our friend and colleague Leslie Manookian of Health Freedom Defense Fund for bringing this suit!
• 3-Letter Agencies Can Be Wrong: The so-called Chevron Deference doctrine, which has been in place for 40 years, was overturned by SCOTUS. Now, instead of deferring to the expertise of agencies on how to interpret ambiguous language in laws pertaining to their work, federal judges now have the power to decide what a law means for themselves. It means for the first time, that the science can be argued in front of a judge, and the dominant paradigm held by our federal agencies can be proven incorrect, since it is now acknowledged that our 3-letter agencies like CDC and FDA can and do get it wrong.
• Your Religious Beliefs Are Yours: In a Tennessee religious exemptions case, a federal jury determined a woman who was fired for refusing a COVID shot, was awarded verdict of almost $700,000. The court found her religious views were sincerely held. This case also means that employers cannot dig into someone’s religious beliefs to determine if they are sincerely held.

After Dr. Fox discusses these exciting wins, we discuss some other potential cases that Free Now Foundation would like to file to further the protection of California’s children. We also welcome a special guest, Dr. Doug Hulstedt whose medical license has been suspended due to his writing of medical exemptions for children.
