In a bold legal move, Free Now Foundation’s federal lawsuit challenges California’s medical exemption process for school vaccinations. We seek declaration forms from parents of vaccine-injured children

California’s medical exemption system is “designed to fail,” says Alix Mayer, Chairman of Free Now Foundation.
“California’s Department of Public Health (CDPH) has systematically overturned legitimate medical exemptions submitted to the state’s CAIR-ME database—nicknamed the ‘anti-vaxxer database.’ These illegal actions leave parents with impossible choices: homeschool your children,leave the state, or face criminal charges for truancy.”
Mayer shared a chilling story illustrating the current climate: after a Ventura mother’s exemption for her child was revoked, she was charged with truancy —despite documented efforts to send her child to school.
It’s actually the school barring entry to the child, creating a situation that prima facie looks like truancy, but is not truancy. The family wants the child to attend school. When the CDPH overturned the child’s medical exemption, the school began to insist on vaccinations the child’s doctor said could cause harm to that child. The school repeatedly sends the child home.
“They threatened the parents with truancy, a charge that can carry jail time, and ambushed the child’s mother with 13 people at a school meeting, including the District Attorney,” Mayer said. “It’s lawfare—it’s terrorism.”
Dr. Fox added, “Convicted criminals on death row have more due process than children facing mandatory vaccines.”
Free Now Foundation’s lawsuit challenges the constitutionality of mandatory vaccination laws by arguing that the foundational legal precedent—Jacobson v. Massachusetts (1905)—is outdated. Jacobson was based on “common knowledge” of the time that people generally accepted that the smallpox vaccine was safe. Today’s CDC-recommended vaccine schedule is linked to a range of injuries and deaths. Since 1986, the National Vaccine Injury Compensation Program has awarded more than $5.3 billion in payouts..
The declaration forms will help disprove the “common knowledge” that vaccines are safe.
“This is no longer about theory,” said Dr. Fox. “Congress has acknowledged vaccine injury, and we have real families and children who’ve suffered. Jacobson assumed vaccines were harmless—now we know that’s not true.”

We urgently request sworn declarations from families whose children have been injured or died following vaccination. These statements can be filled out easily with our declaration forms, and will serve as critical evidence in the case. We can accept declarations from anywhere in the world.
