“The Big One” – Free Now Foundation Sues Newsom Again to Protect All California Children
Free Now Foundation has taken a historic step to protect the rights of all California families. Our lawsuit, filed in a Federal court, alleges eight different violations of due process and paves the way to total freedom for children to attend school unvaccinated.

Free Now Foundation, in partnership with Brave and Free Santa Cruz, has taken a historic step to protect the rights of all California families. Our newest lawsuit, filed in a Federal court, alleges eight different violations of due process and paves the way to total freedom for children to attend school unvaccinated. The suit challenges a fundamental flaw in California Department of Public Health’s vaccine mandates: parents are forced to choose between surrendering their children’s health or forfeiting their right to a free public education.

This is The Big One. We are suing Governor Newsom again—this time for all California’s children,” said Clint Griess, Executive Director of Free Now Foundation,

“We will continue to use legal means to restore parental rights in California and protect vulnerable children from the harms of vaccination. This new case, filed by Free Now Foundation Board Member Richard Fox, MD, JD, uses a novel approach that gives us a pathway to freedom of choice.”

California mandates fail to address the risks of vaccine-related injuries, which studies link to conditions like neurodevelopmental delays, autism, and other serious health outcomes. Many families have been forced into homeschooling or out of the education system altogether.

The day that SB 276 passed the Legislature, thousands of parents held vigil for hours right next to the Bronze Bear outside Governor Newsom’s office doors, imploring him to veto the Bill. Neither the facts about vaccine injuries, nor serving the real needs of California’s Constituents held sway, and Newsom ended up signing the Bill into law. The fight took a heavy emotional toll on thousands of California families. The new law created medical refugees who, without other options to protect vulnerable children from further vaccination, fled the State. Others made the difficult decision to pull children from schools, giving up one parent’s income to homeschool.

Governor Gavin Newsom and CDPH Director Tomás Aragón must now respond to our lawsuit within 21 days, miss the deadline and risk a summary judgment, or file for an extension.

Winning this case means:

  • California families will regain the freedom to make medical decisions for their children without fear of exclusion from schools.
  • All children will have the opportunity to thrive in supportive educational settings without further risk of harm.
  • Parents and children, even beyond California, will see the restoration of their constitutional rights to medical freedom and due process.

This isn’t only about vaccines–it’s about freedom of choice and ending government overreach that disproportionately harms vulnerable families.

    THANK YOU, FREE NOW FOUNDATION!!! This is what I have been praying for for over 5 years!! I am a SoCal mother who was forced into homeschooling ALL SIX of my children after the passage of SB276. Following the vaccine-induced injuries of my two oldest children, I discontinued their vaccinations and did not vaccinate my four youngest children at all. Five years after I obtained a medical exemption for my third child, the school district nurse informed me that the government would be nullifying it and that my children would be denied further education unless I vaccinated them. I disenrolled them from the district and began the tremendously difficult journey of homeschooling a combination of special-needs, typical, and accelerated children right in the midst of menopause. While I love discovering my children’s strengths, areas of need, and learning styles, as well as handpicking curricula that best serve my children’s needs, I am without support and entirely overwhelmed. The news of this lawsuit could not have come at a better time, and I am incredibly hopeful that this lawsuit will restore parental rights and medical freedom once and for all!
